TYPES OF CLAIM

A variety of claims can be issued at the Employment Tribunal. Each type of claim has a different time limit within which the claim should be issued. If you do not issue proceedings within the time limit you are at risk of having any claim you issue struck out.  Also, it is important that all possible claims you have are set out in your application. 

The following is a list of some of the different clams that can be issued at the Employment Tribunal.

DISMISSAL

1.      Unfair Dismissal.

2.      Constructive Unfair Dismissal.

3.      Failure to provide written reasons for dismissal.

DISCRIMINATION

4.     Sex Discrimination.

5.     Race Discrimination.

6.     Disability Discrimination.

7.     Religious Belief Discrimination.

8.     Sexual Orientation Discrimination.

9.     Age Discrimination.

10.   Discrimination on grounds of Marriage.  

EQUAL PAY     

11.   Failure to provide equal pay for equal value work.  

WAGES

12.   Unauthorised deductions from wages.

13.   Failure to provide a guarantee payment.

14.   Breach of the National Minimum Wage Regulations.

15.   Failure to pay renumeration whilst suspended from work for Health

        and Safety reasons whilst pregnant or on maternity leave.

REDUNDANCY

16.   Failure to pay redundancy pay. l

17.   Failure to allow time off to seek work during a redundancy situation.


TERMS AND CONDITIONS

18.   Failure to provide or update a contract of employmentor.

19.   Failure to provide a written pay statement or an adequate pay

        statement.

20.   Breach of contract.

 

TUPE (Transfer of Undertakings (Protection of Employment) Regs

21.    Failure to consult in accordance with the Transfer of Undertakings

         (Protection of Employment) Regulations.

MATERNITY

22.   Suffering a detriment and or dismissal for claimaning under the Flexible

        Working Regulations.

OTHER CLAIMS

23.    Breach of Working Time Regulations.

24.    Suffering less favourable treatment and/or dismissal as a fixed term 

        employee.

25.      Failure to allow time off for trade union activities or duties, ante natal

        care or for public duties.
26.      Failure to pay remuneration whilst suspended for medical reasons,
27.      Failure to allow time off to care for dependants,
28.      Suffering less favourable treatment and/or dismissal as a result of

        being a part time employee.

29.     Suffering a detriment and/or dismissal for refusing to work on a

        Sunday.

30.      Suffering less favourable treatment and/or dismissal as a temporary

        employee.
31.      Suffering a detriment and/or dismissal due to exercising rights under

        the Tax Credits Act,
32.      Failure to limit weekly or night working time, or to ensure rest breaks.
